Terms of Service

1. Acceptance of Terms

By downloading, installing, or using the PinRally mobile application ("Service"), you agree to be bound by these Terms of Service. If you do not agree, please do not use the Service.

2. Description of Service

PinRally is a location-based coordination platform that allows users to:

• Create and manage rally points (coordination rooms) for gatherings and events
• Track real-time arrival status and ETAs of participants
• Coordinate through location-anchored chat and updates
• Share photos, videos, and location information with participants
• Manage participants and broadcast updates (for rally organizers)

3. User Accounts

To use PinRally, you must:

• Be at least 13 years of age (users under 18 require parental or guardian consent)
• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use

4. User Conduct

You agree not to use PinRally to:

• Post content that is illegal, harmful, threatening, abusive, or offensive
• Harass, stalk, or intimidate other users
• Share false, misleading, or deceptive information
• Violate any applicable laws or regulations
• Infringe on intellectual property rights
• Distribute spam, malware, or harmful content
• Attempt to gain unauthorized access to our systems

5. Content and Intellectual Property

Your Content: You retain ownership of content you create and share. By posting, you grant PinRally a worldwide, non-exclusive, royalty-free license to use, display, distribute, and modify such content for the purposes of operating the Service.

Responsibility: You are solely responsible for the content you post. PinRally is not responsible for the accuracy or reliability of user-generated content, including arrival times and location information.

Moderation: We may remove, restrict, or disable access to content at our discretion if it violates these Terms or our Community Guidelines. This includes both automated moderation and human review.

Automated Content Review: PinRally uses AI-powered systems to automatically review rally descriptions and profile information before they are posted. By using the Service, you agree that this content may be processed by automated moderation systems to detect violations of our Community Guidelines. Content that violates guidelines may be rejected with immediate feedback. Note: Chat messages are not pre-moderated to ensure real-time coordination.

AI-Generated Insights: PinRally may use AI services to generate helpful information about rally locations (such as parking tips and accessibility notes). Only place names and addresses are sent to AI providers—no personal identifiable information (PII) or sensitive data is transmitted. These insights are cached and not generated in real-time. AI-generated insights are provided as-is and may not be accurate or complete. You should verify important information from official sources.

Our IP: PinRally, including its trademarks, logos, and original content, are protected by intellectual property laws. You may not copy, modify, or distribute them without our permission.

6. Privacy and Data

Your use of the Service is subject to our Privacy Policy. By using PinRally, you consent to our data practices.

7. Location Services

PinRally uses foreground-only location services to provide coordination convenience features.

• With your consent, your device's location may be accessed only while the app is open and in active use (foreground). We do not collect background location at any time.
• Your GPS coordinates are never shared with other participants, organizers, or any third party. The only location-related information visible to others is the arrival status you manually set.
• You can disable location access through your device settings at any time. Arrival status can still be set manually without location permission.
• We are not responsible for inaccuracies in location data, which may depend on third-party providers (e.g., Google Maps).

8. Third-Party Services

PinRally integrates with third-party services such as Firebase (including Firebase Analytics for app analytics and performance monitoring), Google Maps, and AI services (including Google Gemini for content moderation and place insights). These services may collect or process data subject to their own privacy policies:

• Firebase Analytics: Collects anonymized usage data to improve app performance and user experience (see Privacy Policy for details)
• Google Maps: Provides location and mapping services
• Google Gemini AI: Powers content moderation and place insights generation

We are not responsible for the availability, accuracy, or reliability of third-party services, including AI-generated content. By using PinRally, you acknowledge and accept that these third-party services may collect and process data in accordance with their own terms and privacy policies.

9. Disclaimers

The Service is provided "as is" without warranties of any kind. PinRally does not guarantee:

• Accuracy, reliability, or completeness of user-generated or third-party content
• Fitness for a particular purpose
• Uninterrupted, secure, or error-free service
• That the Service is free of harmful components

PinRally does not provide professional advice of any kind. Information from the Service should not be relied upon for legal, medical, safety, or financial decisions.

10. Limitation of Liability

To the maximum extent permitted by law, PinRally shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, missed meetups, or reliance on user-generated content including arrival times and location data.

11. Termination

We may terminate or suspend your account and access to the Service at any time, with or without cause or notice, for conduct that we believe violates these Terms, our Community Guidelines, or is otherwise harmful to other users, us, or third parties.

12. Modifications to Terms

We may update these Terms of Service at any time. If material changes occur, we will notify users through the app or other communication methods. Continued use after changes constitutes acceptance of the new terms.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of California, United States, without regard to conflict of law principles.

14. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect.

16. Subscriptions and In-App Purchases

PinRally offers auto-renewable subscriptions and one-time in-app purchases. By subscribing, you agree to the following:

• Payment will be charged to your Apple ID or Google Play account at confirmation of purchase.
• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.
• Your account will be charged for renewal within 24 hours prior to the end of the current period at the same price as the original subscription.
• You can manage or cancel your subscription at any time in your Apple ID Account Settings (iOS) or Google Play Account Settings (Android).
• No refund is provided for the unused portion of a current subscription period upon cancellation. Cancellation takes effect at the end of the current billing period.
• Any unused portion of a free trial period, if offered, will be forfeited upon purchasing a subscription.
